INVITATION FOR TENDERS
PROCUREMENT OF BIOGAS PLANT AND AUXILIARY FACILITIES
This Invitation for Tenders follows the General Procurement Notice for this project (7752-GPN-41419), which was published on the EBRD website, Procurement Notices (www.ebrd.com) on December 1, 2014.
OPEN JOINT STOCK COMPANY “SLONIMSKI VODOKANAL”, hereinafter referred to as “the Employer”, intends using part of the proceeds of a loan from the European Bank for Reconstruction and Development (the Bank) and grant from the Swedish International Development Agency (Sida)towards the cost of Slonim Biogas Project implemented within the Belarus Environmental Infrastructure Facility I.
The Employer now invites sealed tenders from contractors for the following contract to be funded from part of the proceeds of the loanand grant:
Contract C(1).
Construction of a Biogas Complex with a total digestion capacity of 115 m3/day of sludge with 3 - 5.5% dry solids content, including construction of complex of structures for sludge stabilization (digesters), structures for utilization of biogas in heating and power supply facilities of wastewater treatment plant located at 120 Pushkina Str., Slonim, Republic of Belarus (further-Biogas Complex).
The construction of the Biogas Complex shall be implemented as a turnkey contract and shall include but not be limited to: developing and obtaining of approval of architectural and construction design, obtaining positive resolution of the state expertise on the design developed in accordance with legislation of the Republic of Belarus, construction of the Works, including supply of all equipment and materials for the Works, putting into operation of completed Biogas Complex and commissioning to the Employer, The Conditions of Contract shall be FIDIC Conditions of Contract for Plant and Design-Build (first edition 1999).
The Biogas Complex shall produce biogas from sludge of municipal wastewater treatment plant and supply electrical energy and heat energy produced from biogas for the Employer’s needs.
The biogas plant shall be based on mesophilic digestion of sludge from the municipal wastewater treatment plant in Slonim.
Works location shall beSlonim Waste Water Treatment Plant. Works completion period shall be 18 months from the Commencement Date.
Tendering for contracts to be financed with the proceeds of a loan from the Bank and Grant from the Sidais open to firms from any country.The proceeds of the Bank’s loanand Sida grant will not be used for the purpose of any payment to persons or entities, or for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations.
To be qualified for the award of a contract, tenderers must satisfy the following minimum criteria:
· the Tenderer is not bankrupt or under bankruptcy procedures according to the national legislation or regulations;
· the Tenderer shall have an average annual turnover over the last five (5) years of not less than EUR 7,5 million equivalent;
· Participation as prime contractor in at least three (3) contracts within the last five(5) years , each with a value of at least EUR three (3) million, that have been successfully and substantially completed and that are similar to the proposed Works;
· for the above or other contracts executed during the period stipulated above, the Tenderer shall demonstrate in addition, the following specific key experience as contractor in successfully completed construction of at least:
· oneproject of biogas plant in the recent five (5) years consisting of digesters having a total capacity of at least 2000 m3, and
· one project including co-generation equipment from biogas, having a total electrical power output of at least 200 kW;
· the tenderer shall submit the Manufacturer’s Authorization, using the form included in Section IV, Tender Forms where the tenderer does not manufacture or produce the Goods it offers to supply;
· the Tenderer shall provide evidence that the Tenderer or its agent will be able to carry out the supplier’s maintenance, repair and spare parts for main and auxiliary process equipment stocking obligations on the territory of Republic of Belarus;
· the Tenderer shall provide evidence that the Tenderer and its sub-contractor(s) shall have or shall obtain prior to the Contract signingall certificates, permits and licences required by the legislationof the Republic of Belarus related to the scope of this contract;
· the Tendererand manufacturers of main plant and equipment shall be certified for quality standard ISO 9001 (or equivalent) or shall submit his own quality assurance plan to demonstrate quality assurance procedures, which shall be applied for the execution of works under this contract.

Upon receipt of appropriate evidence of payment of the non-refundable fee, the documents will promptly be dispatched by courier; however, no liability can be accepted for their loss or late delivery. In addition, if requested, the documents can be dispatched electronically after presentation by the prospective tenderer of an appropriate evidence of payment of the non-refundable fee. In the event of discrepancy between electronic and hard copies of the documents, the hard copy shall prevail.
A two stage tender procedure will be adopted and will proceed as follows:
(a) the First Stage tender will consist of a technical proposal only, without any reference to prices, and a list of any deviations to the technical and commercial conditions set forth in the tender documents or any alternative technical solutions a tenderer wishes to offer, and a justification therefor, provided always that such deviations or alternative solutions do not change the basic objectives of the project. Following evaluation by the Employer of the First Stage tenders, the Employer will invite each tenderer who meets the qualification criteria and who has submitted a technically responsive tender to a clarification meeting. The proposals of all such tenderers will be reviewed at the meeting and all required amendments, additions, deletions and other adjustments will be noted and recorded in a Memorandum. Only qualified tenderers submitting a technically responsive and acceptable First Stage tender will be invited to submit a Second Stage tender.
(b) the Second Stage tender will consist of an updated technical tender incorporating all changes required by the Employer as recorded in the Memorandum to the clarification meeting or as necessary to reflect any amendments to the tender documents issued subsequent to submission of the First Stage tender; and the commercial tender.
A site visit to the Wastewater treatment plant of Slonimshall takeplace on October 15, 2015 at 11:00 (Minsk time) at the Pushkina str. 120, Slonim, Republic of Belarus, 231800, administrative building followed by the pre-tender meeting at 14:00, (Minsk time).
First stage tenders must be delivered to the office at the address below on or before November 11, 2015, 14:00 Minsk time, at which time they will be opened in the presence of those tenderers’ representatives who choose to attend.
All Second-Stage tenders must be accompanied by a tender security of EUR 90 000or its equivalent in a convertible currency usingtherateestablishedbytheNationalBankofRepublicofBelarusonthedatetwenty-eight (28) dayspriortothedeadlineforsubmissionoftenders, and must be delivered to the address below on or before the time and date of the submission deadline specified in the Letter of Invitation to submit Second Stage tenders, at which time they will be opened in the presence of the tenderers’ representatives who choose to attend.The deadline for submitting the second stage tender shall be established after completion of first stage tender evaluation.
